Congratulations are in order for Matt Byrne, Mike Hayes and Smitty for their hot off the press win in the Dyson v. Calumet City case! Plaintiffs, a business owner and 2 of her companies, filed a Section 1983 suit against the City and several of its officials alleging equal protection and due process violations stemming from the City’s denial of plaintiff’s request for a business license to operate a banquet hall. Our team filed a motion to dismiss the complaint arguing plaintiffs’ claims were deficient. The motion was granted but the Court gave plaintiffs an opportunity to amend their complaint to correct the deficiencies.
The second time around, plaintiffs largely restated their original claims, failing to fix the deficiencies. Another motion to dismiss was filed and the Court again granted our motion to dismiss, noting that plaintiffs did not learn their lesson the first time and should not be allowed another opportunity to amend the complaint.
